January 30, 2001 BOS Agenda CONSENT CALENDAR 15. Continued Decision: PLP 97-0046, Wendel Trappe/ Canyon Rock Quarry Resolution denying an appeal by Wendel Trappe of a Planning Commission decision to require an EIR Report for the quarry expansion project and setting the baseline for assessing environmental impacts of the project as 350,000 cubic yards per year (approximately the 5 year average production level of the quarry), on property located at 7525 Hwy 116 N. Forestville, Supervisorial District 5 (Continued from 1/9/01) Background Notes prepared by Kenneth Ellison, PRMD, X1928 In summary, the attached draft resolution requires: 1. Preparation of an EIR focused on air quality, noise, and water quality impacts. 2. The baseline used for evaluating potential environmental impacts of the project will be 350,000 cubic yards per year (approximately the 5 year production average of the existing quarry). In essence, this means that the EIR will be evaluating the difference in potential impacts between 350,000 cubic yards per year production, and the requested 500,000 cubic yards per year production. 3. The no project alternative to be included in the EIR will be for the existing quarry to continue production at current levels until mining is exhausted. Section 15126.6(e) of CEQA Guidelines On January 9, 2001, BOS took two straw votes: one to require an EIR for the project (5-0 vote) and another vote to set the baseline for assessing environmental impacts of the proposed project at 350,000 cubic yards per year (a 5 year average) Vote 4-1, Reilly dissenting and continuing the matter until January 30th for final resolution. The Board directed staff to include in the EIR study of air quality, traffic, noise impacts. Additionally the board directed staff to include potential water quality impacts (i.e. sedimentation) to Green Valley Creek and the threatened aquatic species that live in it. With the EIR focused on these four issues, staff expects that the EIR's treatment of other environmental issues (e.g. geology, aesthetics, etc.) can simply incorporate existing information already developed as part of the initial study and application materials. However, it should be noted that unanticipated issues can arise through the Notice of Preparation process or in connection with public or Agency comments on the Draft EIR. Staff will evaluate any such issues that come up and may adjust the scope of the EIR accordingly to ensure that CEQA standards are met. REGIONAL PARKS 16. Professional Services Agreement with Alcalde and Fay Chair to sign agreement. [BW Note: I wonder why this item is put under Regional Parks? Alcalde and Fay are the lobbyists whose office is in Arlington, a Washington DC suburb. As I recall they are often associated with the Water Agency's problems. Periodically Supervisors Kelley and Smith along with Randy Poole take a trip back there.] 29. Ernie Carpenter is reappointed to the Civil Service Commission. 31. Resolution in support of SB 31 (Chesbro) to appropriate $10 million for research and prevention of Sudden Oak Death. 32. Support of AB 62 (Migden) to appropriate $5 million for the prevention, control and eradication of Sudden Oak Death. 33. Support of AB 53 (Wiggins) for research and prevention of Sudden Oak Death including development of a management plan for landowners impacted by Sudden Oak Death, targeting $5 million to aid landowners in the hardest hit counties. REGULAR CALENDAR SONOMA COUNTY WATER AGENCY 38. Policy direction to the Water Agency whether to proceed with an agreement to operate the Mayacama Wastewater Facility. This item is WITHDRAWN. PRMD 45. License for Use of Guerneville Bridge, Plaza Area, and County Right-of-Way by RR Chamber of Commerce. Use of the Pedestrian Bridge and Plaza for special events is not subject to the County Zoning Ordinance. Enter into one-year license with the Chamber for the use of the bridge and plaza and County right-of-way. Authorize staff to work with the RR Parks and Rec District to explore possible management of the property. REGIONAL PARKS 46. Outdoor Recreation Plan: Direction Request that the Board authorize the Regional Parks Department to complete the Outdoor Rec Plan. The schedule would be the submission of the Plan and Initial Study to PRMD in May 2001. Estimated completion date would be September 2002. The Plan has 101 separate projects. 48 are new. TRANSPORTATION AND PUBLIC WORKS 47. Grove Street Community Traffic Controls *Installation of speed bumps on Orange Avenue. *Intersections of Solano at Orange and Solano at Olive will be stop intersections. *Prima facie speed limit of 35 mph on Carriger Rd. *Prima facie speed limit of 25 mph on Olive. 2:15 Afternoon Hearing: To consider an appeal by William and Denise Burns of a Board of Zoning Adjustments decision approving a request by Sonoma Valley Academy to build a private elementary/secondary school with an 8,624 sq. ft. classroom building and a 6,848 sq. ft. barn. Negative Declaration 21254 Broadway, Sonoma Resolution Preview: The use will not be detrimental to the health, safety, peace, comfort and general welfare of persons residing or working in the neighborhood. The circumstances the case are these: a) Widening Watmaugh Road frontage, improving intersection radius and providing tapers at the driveways will reduce traffic impacts to less than significant. b) Requiring fencing and landscaping will resolve potential adverse impacts that may occur as a result of various school activities particularly as to the effect on the adjacent parcel to the south. c) The condition requiring that drainage improvement plans be submitted prior to the issuance of a building permit will assure that the establishment of a school on this site will not further aggravate flooding problems in the area. d) Visual impacts will not be significant since buildings will be located outside the scenic corridor setback and as site improvements will be subject to design review. e) Requiring a 100' ag setback along the southerly boundary and all school enrollments and employees be provided with written notification the school is located near ag lands and that pesticide application, dust, odors and other nuisances associated with ag activities may occur will reduce the impact to less than significant. NOW THEREFORE BE IT RESOLVED that the SC BOS hereby adopts the Negative Declaration. The board certifies the Negative Declaration has been completed, reviewed, considered together with comments received during the public review process in compliance with CEQA and State and County Guidelines and finds that the Neg Dec reflects the independent judgment of the board. BE IT FURTHER RESOLVED that BOS denies the appeal thereby upholding the Board of Zoning Adjustments decision and approving the use permit, subject to the conditions in Exhibit A attached hereto.
