Water Rights Permits for Russian River Project

SCWA operates the Coyote Valley and Warm Springs Dam projects under water rights issued by SWRCB in:

Decision 1030 (1961), 
Decision 1416 (1973), 
Order WR 74-30 (1974), 
Order WR 74-34 (1974), and 
Decision 1610 (1986).  

Total extraction rate is 180 cubic feet per second (cfs) at Wohler-Mirabel and 75,000 acre-feet per annum (afa) (180 cfs = 116.3 million gallons per day[MGD]) Existing contracts is for 95.8 MGD.

SCWA holds licensed Applications 14826 and 15779 for summer storage of water at small recreational dams: 

Healdsburg Memorial Beach at 12.5 afa May 15 to June 1 and 0.15 cfs May 15 to October 1; 
Vacation Beach for 48 afa May 15 to Sep 15; 
Guerneville for 18 afa May 15 to September 15; and 
Fitch Mountain 9 afa May 15 to September 15.

Applications:

Application 12817/8: filed in 1949 and became the Warm Springs Project

Application 12918 - State filing for year-round diversion of 330 cfs and 216,000 afa from Dry Creek assigned to SCWA for essentially the same project as Application 19351.  App.#12918 was canceled in Decision 1416.

Application 12920 - filed by the State Department of Finance on January 28, 1949 pursuant to Section 10500 of the Water Code.  (10500: Appropriation of Water by Department of Water Resources.  Applications filed pursuant to this part shall have priority, as of the date of filing, over any application made and filed subsequent thereto.)

Application 12919A - storage of water at Lake Mendocino and direct diversion of East Fork Russian River water at Wohler-Mirabel.  Transferred to SCWA 335 cfs by direct diversion and 122,500 afa by storage under both applications from the waters of the East Fork Russian River. [Appl. 12919A alone allowed 92 cfs, 37,544 acre-feet per annum (8K then 10K)].  For municipal, industrial, domestic and recreational use.

Application 12920A - For irrigation and domestic purposes.  Appl 12919A and 12920a approved authorizations were subject to prior or subsequent rights in Potter Valley; subject to all rights of any county in which appropriated water originates to the extent that such water is necessary for the development of that county lying within the watershed above Lake Mendocino; subject to the agreement between SCWA and DF&G dated August 21, 1959 requiring that the minimum flows be maintained in the river below Lake Mendocino for the preservation of fish, wildlife and recreation: 25 cfs immediately below Coyote Dam and 150 cfs or the inform to Lake Mendocino, whichever is less, at the Forks, and 125 cfs below Mirabel Park.

Application 15736/15737/15779 - Surplus flow: direct diversion of 20 cfs year-round for municipal, industrial and domestic purposes and 60 cfs from April 1 to September 30 for irrigation and incidental domestic purposes. License obtained under 15779 (not park of the Russian River Project)and storage of 213 afa from the Russian River to be collected from May 1 to November 1 for recreational purposes with following Vacation Beach 48 af, Guerneville 18 af, Healdsburg 102 af, Fitch Mountain 9 af, Asti 18 af, and Cloverdale 18 af.

Application 19351- storage of water at Lake Sonoma and direct diversion of 180 cubic feet per second (cfs) at Wohler-Mirabel.  Requested 290 cfs and the language in Decision 1610 makes the status of the remaining 110 cfs under that application uncertain.  "The State Board may have the jurisdiction to increase both the rate of diversion and rediversion and the annual limits without such increase being considered a new right."

Permits:

Permits 12947A, 12949, 12950, 16596: Increase of direct diversion and rediversion of stored water at Wohler and Mirabel Park from: 

 92 cfs and 37,544 acre-feet per annum (afa) to:
 180 cfs and 75,000 afa

Permit 12947A:  Add Redwood Valley County Water District, amended to make 10,000 afa available for appropriation by other water users in the Russian River Valley in Sonoma County.

Permit 12947B:   8,000 acre-foot reservation

Permit 16596: remove restrictions on use of stored water, authorization to redivert stored water up to 75,000 afa at Wohler and Mirabel Park

Permits 12947A, 12949, 12950: complete construction by 12-1-95 to use water for beneficial use by 12-1-1999

Permits 12947A, 12949, 12950, 16596: add Windsor Water Districts wells as additional points of diversion.

Board Orders:

WR 74-30:  Adopted on October 17, 1974 modified permits approved by Decision 1030 for App. 12919A, 12920A 15736 and 15737. Permits issued jointly to SCWA and MCRRID under 12919A and 12920A (Permits 12947 and 12948) were replace by individual permits.  SCWA issued Permit 12947A and MCRRID issued Permit 12947B.  Decision 1030 uses were combined into each of the new permits.  SCWA direct diversion was reduced from 212 cfs to 92 cfs year round and points of diversions were limited to the Wohler and Mirabel Park intakes since SCWA had no plants to construct intakes at Monte Rio or Healdsburg. Storage remained at 122,500 afa in Lake Mendocino for both new permits.  MCRRID received year-round direct diversion of 53 cfs.  The maximum combined quantity of direct diversion and rediversion of stored water was limited to 8,000 afa.  SCWA was limited to 92 cfs and a maximum of 37,544 af per water year.  A new term included the release from storage as needed to meet the demands of junior appropriators not to exceed 10,000 afa in the Russian River Valley in Sonoma County.

WR 74-34:  Adopted on November 21, 1974.  Approved SCWA petition to reconsideration of Order WR 74-30. Limited purpose of determining whether the maximum annual amount of 37,544 af per water year should be increased since that amount was based on anticipated 20 year exports through the then proposed aqueduct system as set forth in Decision 1030 and may not have been intended as a limit on such exports.  Temporary permits have been issued to SCWA for diversion or rediversion of additional quantities of water during August and September when demand in the service area was greater than the imposed limit.

WR 79-15:  Adopted June 21, 1979.  Added Redwood Valley County Water District to the place of use of MCRRIDs Permit 12947B as interim supply of water for up to 4,000 afa out of MCRRID's 8,000 afa right. Limited to when the water level in Lake Mendocino is above the conservation pool (currently 72,300 af) and when the flow in the Russian River at the confluence of the East Fork exceeds 150 cfs.

WR 81-12: Adopted September 17, 1981.  Validated issuance of a temporary permit under Application 26991 to SCWA for direct diversion from the Russian River at Wohler-Mirabel of 75 cfs not to exceed 2250 af from September 15 to September 30, 1981 for municipal purposes.

WR 84-13:  Adopted September 20, 1984.  Validated issuance of a temporary permit under Application 28228 to SCWA authorizing rediversion at the Wohler-Mirabel intakes of 2975 af of stored water from Lake Mendocino between September 1 and September 30, 1985 for municipal purposes.

WR 85-7:  Adopted August 22, 1985.  Validated issuance of a temporary permit under Application 28522 authorizing direct diversion from the Russian River at the Wohler-Mirabel intakes of 92 cfs between August 16 and September 30, 1985 for municipal purposes.

Decisions:

Decision 935:  adopted May 5, 1960 approved appropriations for SCWA and MCRRID, jointly, under Application 12919A and 12920A, and approved appropriations for SCWA under Applications 15736, 15737, and 15779.  The Board, acting on a petition for reconsideration, vacated this decision by order adopted on June 10, 1960.

Decision 1030:  Adopted August 17, 1961 approved SCWA and MCRRID's jointly held applications 12919A and 12920A for maximum year-round storage of 122,500 afa in Coyote Valley Reservoir (Lake Mendocino) and 212 cfs direct diversion of East Fork Russian River water.  Segregated as: 62.0 cfs at Wohler intake; 23.0 at Mirabel Park; 3.5 at Monte Rio; 3.5 at Healdsburg; 53.0 cfs at various points along the East Fork Russian River and Russian River below Coyote Valley Dam in Mendocino County; and 67.0 cfs at various points along the Russian River in Sonoma County.  

Decision 1416:  Adopted on March 15, 1973.  Approved the storage portion of SCWA's amended Application 19351.  Authorized storage of 245,000 afa from Dry Creek in Warm Springs Reservoir (Warm Springs Dam/Lake Sonoma) from October 1 to May 1 for domestic, municipal, industrial and recreational purposes.  Subject to agreement dated February 24, 1970 between SCWA and F&G requiring a minimum flow in Dry Creek of 25 cfs from April 1 through November 30 and between 50 cfs and 75 cfs from December 1 through March 31 depending on reservoir levels.  Export of stored water for use outside the Russian River watershed was made subject to all present and future appropriations for use within the watershed.

Decision 1610: Adopted on April 17,1986.  Approved the completion of construction projects by December 1, 1995 and the time to complete beneficial use of water extended to December 1, 1999. Maximum combined rate and quantity of direct diversion at the Wohler and Mirabel Park pumping facilities should be limited to 180 cfs and 75,000 afa. Stream flow requirements are 25 cfs in East Fork Coyote Dam to confluence of East Fork with Russian River.  Flows in the Russian river between Dry Creek and the mouth will be a minimum of 125 cfs.
